Morris + Stoltz + Evans LLP is a dynamic boutique retained on challenging medical negligence, health care, public health and patient advocacy matters. We advise patients and their families, health care providers and other health system participants on their rights and responsibilities and on health policy issues across the system. Our clients benefit from the responsive service, creative solutions and exceptional advocacy and opinion work that we pride ourselves on providing.

  • Medical negligence

We are recognized leaders in medical negligence litigation. We act for patients injured while receiving care, in complex litigation that is often challenging. We strive to achieve the best possible results for our clients and their families, in and out of the courtroom.

Morris + Stoltz + Evans LLP offers services on a contingency basis. Our contingency fees range from 25% – 35% depending on the circumstances of each individual case.

  • Patient safety and accountability in health care

We help patients and their families raise their concerns and advocate for safety and accountability in the health care system using means other than civil litigation, including coroners’ inquests, commissions of inquiry and complaints procedures under the Regulated Health Professions Act.

  • Professional regulation

Our team has a wealth of experience on matters involving professional regulation. With our advocacy skills and expertise in the healthcare sphere, we are well positioned to act on behalf of governing bodies of regulated health professions in disciplinary prosecutions and investigations, as well as to provide advice and policy recommendations as general counsel.

  • Access to health care

We represent patients and others facing challenges in accessing health care, including individuals seeking funding for out-of-country treatment under Ontario’s Health Insurance Act and vulnerable populations such as prisoners and aboriginals without access to needed health services.

  • Privacy in the health system

We advise patients, health care providers and other health system participants on their rights and responsibilities to safeguard the privacy of personal health information and related matters.

  • Consent and capacity

We are strong advocates of the right of patients to exercise self-determination in medical decision-making, including acting for clients before the Consent and Capacity Board.

  • Public health matters, including HIV

Public health systems at the local, provincial and federal levels aim to protect and promote the health of populations, addressing matters such as infectious diseases like HIV and SARS and the safety of medical drugs and devices. We advise patients, community-based organizations, public health authorities and other actors engaged in or affected by the public health system.

  • Health policy, regulation & governance of health care and research

We help patients, health care providers, health research organizations and other health system participants to navigate the complex legal framework that governs health care delivery and clinical research involving patients, and to advocate for and implement meaningful system changes.
